California Car Dealership Defense Attorney
Automobile Dealer Disputes
Campbell, Lauter & Murphy has successfully defended a variety of claims against car and truck dealerships involving product defect claims and claims involving the so-called "Lemon Law."
Besides cases involving "lemons" - cars with multiple defects, the firm has defended claims of fraud, odometer tampering, wrongful termination, discrimination, sexual harassment, and other allegations against automobile dealerships. We know how to protect the interests of our clients when such claims are made, and have developed an outstanding reputation as vigorous defenders of clients who are the victims of frivolous claims.
Representative Cases Handled:
Mr. Lauter has vigorously defended numerous "Lemon Law," Magnuson-Moss, Business & Professions Code 17200, Song-Beverly Consumer Warranty Act, Consumer Legal Remedies Act, and other causes of action against automobile dealerships. Some of the dealerships he has represented include Rancho Ford Lincoln Mercury, Gosch Ford, Tustin Nissan, Frank Toyota, Sunrise Ford, Raceway Ford, North County Ford/Automotive Group, and Shaver Auto Center.
Although most of these cases involved allegations that the cars were "lemons" with multiple defects, Mr. Lauter has also defended automobile dealers in claims of fraud, odometer tampering, wrongful termination, discrimination, sexual harassment, and other allegations. One of the longest running cases was Krupps v. Tustin Nissan, where plaintiff claimed that the leased vehicle was used and not new, as represented. Mr. Lauter won on summary judgment on the basis that plaintiff could not prove any damages, but this ruling was reversed on appeal. The appellate court questioned plaintiff's claim, and found that there was a minimal amount of evidence that he might have been damaged. On the eve of trial, Mr. Lauter was successful in settling this case for much less than the $150,000 initially sought by plaintiff.
